These Terms of Use (“Terms”) govern your access to and use of the Validation360 platform
(“Platform”).
By accessing the Platform, submitting materials, purchasing credits, or subscribing to
Validation360, you agree to be bound by these Terms. If you do not agree, you must not use the
Platform.
Overview of the Platform
Validation360 is a software-based validation system designed to identify gaps in assessment tools
and learning resources that may expose Registered Training Organisations (RTOs) to regulatory
risk.
The Platform applies structured, audit-informed validation logic through layered, independent
checks to deliver consistent and scalable analysis.
Validation360:
- provides structured gap analysis and rectification insights
- does not act as a consultant or compliance authority
- does not guarantee audit outcomes or regulatory compliance
All compliance decisions and implementation actions remain the responsibility of the RTO.
Free Validation Preview
Validation360 may offer a free validation preview.
This allows you to:
- submit real assessment tools and supporting materials
- see how the Platform processes and evaluates submissions
- access initial findings and early-stage gap indicators
The preview is limited in scope. Full validation reports, detailed findings, and rectification
guidance are only available through paid access.
Access, Credits, and Subscriptions
Access Model
Access to the Platform is provided through:
- prepaid validation credits; or
- subscription-based plans
The platform, validation logic, report structures, and system processes remain the intellectual
property of Validation360. They may not be replicated, reverse engineered, resold, or
distributed externally.
Credits
- Credits are applied per validation submission
- Credits are prepaid and non-transferable
- Credits do not represent ownership or entitlement beyond their use within the Platform
Subscriptions
- Subscriptions provide access to validation capacity within an active billing period
- Access continues only while payments remain current
- Unused allocations do not roll over unless explicitly stated
Use of Outputs
Validation reports and outputs are provided for internal organisational use only, including:
- compliance review
- audit preparation
- rectification planning
You must not:
- distribute outputs externally for commercial purposes
- resell or repurpose outputs as a product or service
- misrepresent outputs as independent certification or compliance approval
Intellectual Property
All rights, title, and interest in the Platform remain with Validation360, including:
- validation logic and methodology
- system workflows and processes
- report structures and output formats
You must not:
- copy, replicate, or reverse engineer any part of the Platform
- attempt to extract or recreate the underlying validation system
- use the Platform to develop competing products or services
Professional Responsibility
Validation360 delivers structured analysis based on encoded validation logic.
You acknowledge that:
- the Platform identifies potential risks and gaps
- implementation decisions are made by your organisation
- compliance outcomes depend on how identified issues are addressed
The RTO remains fully responsible for:
- governance and oversight
- assessment practices
- regulatory compliance
Fees and Refunds
All fees are payable in advance unless otherwise agreed.
Refunds:
- are not provided once full validation reports have been delivered
- are not provided for unused credits or subscription periods
Nothing in this section limits any rights you may have under applicable consumer law.
Acceptable Use
You agree not to:
- use the Platform for unlawful or misleading purposes
- upload content you do not have the right to use
- interfere with or disrupt the Platform’s operation
- attempt unauthorised access to systems or data
Validation360 reserves the right to suspend or terminate access where misuse is identified.
Limitation of Liability
To the maximum extent permitted by law:
- Validation360’s liability is limited to the total fees paid for credits or subscriptions
- Validation360 is not liable for:
- audit outcomes
- regulatory decisions
- sanctions or enforcement actions
- losses arising from reliance on Platform outputs
The Platform is provided as a decision-support tool, not a compliance guarantee.
Changes to the Platform or Terms
Validation360 may:
- update or modify the Platform
- revise these Terms from time to time
Continued use of the Platform after changes are made constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of Australia. Any disputes will be subject to the
jurisdiction of the relevant courts of that jurisdiction.
